A divided legislature is locked in historic debate. Debate opened up in the Massachusetts statehouse Wednesday over same-sex marriage. The constitutional convention is debating an amendment that would define marriage as the union between a man and a woman. The Legislature earlier narrowly defeated one version of the amendment banning gay marriage but has now moved on to another. The version now being debated would also ban gay marriage, but would create civil unions that would offer many of the benefits of marriage to same-sex couples. The debate is expected to last well into the evening. The amendment would have to be approved by the current legislature and next session's legislature before it can be put on the ballot for a final decision by voters. The earliest that could happen would be November 2006. Just last week, the Massachusetts Supreme Court ruled that marriage licenses could be issued to same-sex couples beinning in May of of this year. Next week, New Hampshire's State Senate takes up a bill that would also ban gay marriage. We'll have highlights and analysis of the hearing and debate next Tuesday. |

Turning now to our continuing focus on prescription drug reform in the Granite State. Governor Craig Benson said on Wednesday that's he's seeking permission from the federal government to re-import prescription drugs from Canada. The governor is submitting a waiver request to Health and Human Services Secretary Tommy Thompson, who has the power to exempt the state from the current import ban and allow re-importation of the drugs. This move comes in spite of recent complaints by New Hampshire pharmacists pharmaceutical companies. |

Gov. Craig Benson - "Pharmaceutical companies make the highest profit margins of just about any industry in this country. they make more than car companies, oil companies, any other industry. So I don't feel bad for them. And what I think we need to do is make drugs affordable and available for everybody who needs to take them. We have some great breakthroughs, but as you know, a lot of our tax dollars paid for those breakthroughs - and yet we're getting charged repeatedly for that." |

Also at the statehouse. The New Hampshire Supreme court has a new judge. Judge Richard Galway received his confirmation to the state's highest court Wednesday morning. He will be sworn in on Friday. He fills the spot vacated by Chief Justice David Brock, who retired in December. Galway is best known for his 2001 ruling that overturned the state education property tax and ordered the state to refund the 880 million dollars it had collected. Galway's decision was later overturned by the state Supreme Court. |

THEY HAVE TO PUT THEIR PHYSICAL ADDRESS FROM WHERE IT'S COMING FROM. THEY HAVE TO STOP DISGUISING SUBJECT LINES AND HEADERS." MIKE NIKITAS - "JUDGING FROM MY INBOX IN THE MORNING, NOT ALL SPAMMERS ARE FOLLOWING THESE NEW RULES." JONATHAN HOPPE - "NO, I MEAN, THEY'RE UNETHICAL TO BEGIN WITH. WHY CHANGE AND ALL OF A SUDDEN BECOME ETHICAL OVERNIGHT? IT'S SILLY." MIKE NIKITAS - "IS IT WORKING? BRIAN MCWILLIAMS - "I DON'T THINK SO. WE HAVEN'T SEEN A CHANGE AT ALL IN THE LAST 30, 45 DAYS." BRIAN MCWILLIAMS - "I THINK IT WILL TAKE A BIG HIGH-PROFILE PROSECUTION OR TWO BEFORE SPAMMERS THINK THAT THIS LAW HAS ANY TEETH IN IT. I THINK THE LAW WAS A GOOD IDEA BUT YOU HAVE TO SOME PUBLIC HANGINGS BEFORE ANYBODY WILL BE SCARED OF IT. ALMOST LIKE WHEN THEY WENT AFTER, YOU KNOW, A 12-YEAR-OLD FOR DOWNLOADING MUSIC, SOMETHING LIKE THAT, WHERE THEY PUBLICIZED PEOPLE'S NAMES AND THAT KIND OF THING." MIKE NIKITAS - "WHEN THE GOVERNMENT TRIES TO ENFORCE THIS KIND OF THING, I MEAN, DO THEY HAVE THE RESOURCES TO ENFORCE THIS KIND OF THING? LIKE TO ACTUALLY. YOU'RE DOING A BOOK. YOU TRY TO TRACK THESE PEOPLE DOWN. IS THE GOVERNMENT ABLE TO DO THAT?" BRIAN MCWILLIAMS - "SURE. I MEAN, SPAMMERS ARE NOTORIOUSLY SLOPPY. THEY CAN BE FOUND. IT'S JUST AS WE MENTIONED THE COST OF ENTERING THIS BUSINESS IS SO LOW, THESE GUYS PROLIFERATE. I MEAN, IT'S A WHACK THEM ALL KIND OF GAME. THAT WILL GIVE YOU A CLEAN SLATE TO START WITH AND NOTIFY YOUR FRIENDS AND FAMILY OR WHOMEVER YOU USUALLY COURSE WITH WHAT YOUR NEW EMAIL ADDRESS IS AND SAFEGUARD IT. DON'T STICK IT ON THE INTERNET. DON'T PUT IT ON MESSAGE BOARDS AND THOSE SORTS OF THINGS. THAT WILL HELP QUITE A BIT. OTHER THAN THAT, I'D CERTAINLY GET SOFTWARE IN PLACE TO START SCANNING INBOUND MAIL."
