How much do you know about New Hampshire's Supreme Court? Inside this building modeled in the colonial Williamsburg style, the Court has the final say in the New Hampshire Court system. Hello, I'm Beth Carroll and welcome to New Hampshire Outlook. I'm inside the Supreme Court where justices hear oral arguments in hundreds of cases each year. In 2007 PBS produced a special series on the history of the UNITED STATES Supreme Court and the role it has played in shaping our nation. New Hampshire's justices have also played a pivotal role in shaping our history. In this program Outlook's Richard Ager brings us an unprecedented look at the Granite State's highest court. |

The Supreme Court reviews appeals from the state trial courts and determines whether ORAL arguments would be helpful in deciding a case. Attorney Doreen Connor from the Manchester law firm of Wiggin & Nourie has had a lot of practice arguing before the high court. Q Doreen, you've gone through dozens of oral arguments in the last 21 years tell me what it's like to stand here and state your case? Is it intimidating? Q Justice Broderick talks about the power of oral argument in shaping their opinion. How do you go about preparing your ORAL argument. Q Is arguing a case before the Supreme Court that DIFFERENT from arguing a case before a lower court? Q Do you think oral agruments make or break the case? Do they win the case? Q Justice referred to what's called a 3JX.9 a rocket docket? What is that. how does it differ? ** from an atty's perspective can walk us thru the process. from argument to opininon -- what's involved. ======= Q Chief Justice Broderick told Richard there's no way to make oral arguments comfortable -- how nerve-wracking are they? Do you think about everything from your words to what you're wearing? Q The Chief Justice's advice to attorneys is to forget the 15-minute uninterrupted speech and welcome and address the questions of the court -- is that difficult to accept? Do you agree? |

The Supreme Court building houses the NH law library -- the only public law library in the state. Learning about the courts and how state government works is all part of the school curriculum in NH classrooms. The goal is to educate and "engage" students in politics and civic life. But, how do you make it more than just an "academic experience?" Show them how to make a difference. We introduce you to a group of local students who set out to clean the ocean -- and in the process discovered the power of legislation to create change. |

TRK1: Concern about marine pollution prompted a group of environmentally minded 6th graders from Londonderry to launch a public awareness campaign. TRK3: They call themselves the inventioneers. They're part of the First Lego League, and after-school science and technology competition launched by inventor Dean Kamen. TRK 4: The project has brought the kids some notoriety. TJ: 1:31:13 after the research project we entered this contest…milk company hosting…and we won first place for NH and now we're on the milk carton 1"31"25 ***** TRK5: Organic Cow …applauded the young leaders for carrying their beliefs beyond the classroom. 1:47:09 *** COVER 1:51:57 it was just the greatest gratification for them.this is a big co that cares about the environment…and they were recognized for their efforts 1:52:06 beth: 1:33:56 So, you guys actually got down and dirty and did beach cleanups too? **** yes, what did you find.3 ballons and plastic materials 1:34:07 we even found a shoe 1:234:10 **** a lot of trash 3 ballons not much 1 small beach that's a lot of balloons 1:34:21 ***** 1:29:46 we realized balloons were a very big problem…and that lots of animals like to eat them because they look like jellyfish. 1:29:52 1:10:14 another of the problems is the string, most think it's a piece of paper but its actually a polymer or plastic and that will never go away and it can get tangled around a birds neck…or it can really its almost as dangerous as the balloons themselves. 1:34:22 Beth: you guys aren't anti-balloon are you? I like balloons…its just releasing them is a problem 1:34:29 TRK: So, the Inventioneers decided to take action. Girl: 1:30:13 so, I called Mr Waterhouse and we had a meeting with him here… we talked to him about how NH passes a bill and how it turns into law and he talked to us very seriously because we were serious about this. 1:30:45 1:15:48 REP WATERHOUSE: the first step is to get it thru the house of representatives 1:08:22 -:34 REP: We'll go and testify as to the dangers these balloons cause for marine animals and how important it is to NH that we maintain our pristine coast and the health of our seabirds, our turtles and seals 1:21:22 and with your help we'll try to get this accomplished… thank you 1:21:26 01:33:24 Beth SU BALLOON RELEASES HAVE LONG BEEN A POPULAR WAY OF MARKETING GRAND OPENINGS, PROMOTIONS, WEDDINGS, EVEN FUNERALS. UNDER LEGISLATION PROPOSED BY REP. WATERHOUSE AND A TEAM OF INVENTIONEERS IT WOULD BE ILLEGAL TO RELEASE MORE THAN 26 HELIUM BALLOONS IN LESS THAN AN HOUR. AT BALLARD'S NOVELTY IN CONCORD WHICH SPECIALIZES IN BALLOONS THEY SEE IT VERY DIFFERENTLY. 1:21:35- I don't think we should prohit party stores or balloon artists from doing a portion of their business where they could use the financial gain from doing that balloon release. KIDS: sara: what would you say to businesses. environment 1:17:00 / We can't put latex balloons in the same category as plastic litter it's not the same thing… Plastic does not biodegrade. Norm: 1:23:53-1:24:02 I think its wonderful that the students want to get behind an issue and rally the banner but before they take up arms they should understand who they are fighting and why they are fighting. 1:24:04-1:24:26 They are fighting one balloon that has a ribbon on it that was probably released by one child and they aren't thinking that a balloon release don't have a string. They won't find a balloon that was released in the altitude of 5 miles because it shattered. cmte hearing: 19:56 Chair would like to call Anne Stewart TRK 7: On hearing day - Sarah, Ann, Paige and TJ …all came ready to testify for house bill 62 limiting the release of ballons in NH. ANN 20:32 one of the concerns we have about balloons is that first and foremost they are litter:38 Sara/ 17:26 W want to make sure everyone has a rubber band in front of them. 17:35-:39 another thing that's really dangerous about the balloons is the strings 17:45 If you take the rubber band and move it around your pinky and back of your hand and over your thumb…take your other hand and put it on your elbow and try to get the rubber band off only using your hand don't scrape it on the table or your chin or anything 18:07 It can be really hard to get this off this is very similar to what a sea turtle or a bird is trying to do with the strings 18:18 **** 2:2:09 Lastly we are concerned about some of the claims ballon manuf make and how quickly they degrade in the environment.:18 one of those claims degrade as quickly as an oak leaf fail to tell you it takes 4 years for it to degrade 22:28 22:27 30 also, when balloon pieces are submerged they are not exposed to sunlight which takes them longer to degrade.** 22:37 TJ 23:28 we are 23:28 We are working on a brochure to inform public of impact ballons have on wildlife 23:34 27:06 will you have price on brochures or handed out for free. 27:10 WE'LL probably hand them out for free, cause its to inform the public not to create a revenue 27:16 *** Sara: One of the ways we plan to support our brochures.we did get an award, a grant from the Organic Cow milk company, on the side of the 2 percent I think, for our project we will use some of that funding to go towards our brochures 28:53 **** TRK: Students quickly learned that when it comes to funding - support for a bill can falter. 32:26 MAJOR: While released ballons will have an impact on wildlife and environment. this proposal is beyond the scope of the dept's mission and places the responsibility on law enforcement division w/out providing any funding 32:36 **** Therefore the NH fish and game commission respectfully requests that you oppose HB 62 as it is written:48 and thank you for your consideration 32:50 **** TRK: The beauty of the NH system is that every bill gets a fair public hearing. Once the Agriculture and Environmental committee recommends or rejects HB 62 - it will get an up or down vote before the full house. Beth 1:28:05 This is not a friviolus bill.it certainly is not the most important issue we have to deal with in concord this year.but it is serious 1:28: 23 *** We are losing some of our wildlife to something that can be prevented 1:28:27 …and its going to reaise awarness 1:28:30 …especially among the young people who have been bringing this idea out and who are contininug to talk to other kids about it to let them be aware that ecology is something they can affect , need to be aware of , and need to work on. 1:28:43 *** are you optimistic bill will pass. 1:55:18 we are.I think the kids feel even if it doesn't pass people will learn.and that's their goal 1:55:25 TRK: Win or lose, the inventioneers say its time NH gets a grip on its balloons. 1:49:12 early on they said…we want to make a difference, and we're kids but we can make a difference. 1:49:41 and I think they succeeded. The "Inventioneers" intend to follow the balloon proposal as it winds its way thru the legislative process. By the way, a handful of states have already banned mass launches of balloons including CT, NY, Virginia, Florida, and Tennessee. Legislation is also pending in other states. |
